Welcome to Dory. In these Terms of Service ("Terms"), "Dory", "Dory Home", "we", "us" and "our" mean Thomas David Short, a sole trader trading under the brand "Dory Home". Dory operates this store and website at shop.doryhome.com (the "Services"), powered by Shopify. By using the Services you agree to these Terms and to our Privacy Policy.

Current scope. During the pre-campaign phase, the Services are used only to take a fully refundable reservation deposit of USD 1 (the "Reservation Deposit"). No physical product is sold or shipped at this stage. See the Deposit Refund Policy, the Shipping Policy and the Return and Refund Policy.

1. Access and account

You confirm that you are at least the age of majority in your country of residence, or that you have the consent of a parent or guardian for any minor who uses the Services on your devices. You agree to provide accurate information, to keep any credentials secure, and not to transfer or sell your account.

2. Our products

We try to represent our products and the Reservation Deposit accurately, but colours and appearance may differ from images, and descriptions may change. We do not warrant that appearance or quality will meet your expectations beyond what mandatory consumer law requires. We may discontinue or limit quantities by person, region or jurisdiction.

3. Orders and the Reservation Deposit

Placing an order, or a Reservation Deposit, is an offer that we may accept or decline. A transaction is accepted only when we confirm it. Payment may be processed before acceptance; if we cannot accept, we refund you. The Reservation Deposit is fully refundable and creates no obligation to buy: see the Deposit Refund Policy. Purchases are for personal or household use only, with no resale or unauthorised export. Future physical purchases are subject to the Return and Refund Policy and to your statutory withdrawal rights.

4. Prices and billing

Prices, discounts and promotions may change without notice. The price that applies is the one in effect at the time of your order, as shown in your confirmation. Posted prices exclude taxes, shipping, handling and customs unless stated. You agree to keep your payment information current and confirm that you are authorised to use the payment method you provide. The Reservation Deposit is USD 1.

5. Shipping and delivery

No physical goods are shipped during the reservation and pre-campaign phase: see the Shipping Policy. When physical sales begin, delivery times will be estimates, and risk and title will pass in accordance with mandatory consumer law (for consumers, risk passes on physical delivery to you or a carrier you appointed). This section does not limit your statutory rights.

6. Intellectual property

The Services and all related trademarks, brand features, text, displays, images, graphics, reviews, video and audio, and their selection and arrangement, are owned by Dory or its licensors and are protected by Italian, European Union and applicable foreign intellectual property laws. You may use the Services for your personal, non-commercial use only. You may not reproduce, distribute or create derivative works without our consent. Dory and Shopify trademarks are protected. All rights reserved.

7. Optional tools

We may provide access to third-party tools "as is" and "as available", without warranties, and you use them at your own risk. New features are also subject to these Terms.

8. Third-party links

The Services may link to third-party content or sites that we do not control. We are not responsible for them, and you access them at your own risk. Direct any complaint about a third-party site to that third party.

9. Relationship with Shopify

The Services are powered by Shopify, which enables us to provide the Services to you. You acknowledge and agree that any sale made through the Services is a direct sale from Dory (and not from Shopify), and that Shopify is not responsible for any aspect of the underlying transaction between you and Dory, including the products or services purchased and any harm or damage arising from them. You release Shopify and its affiliates from any claims, damages and demands of every kind arising out of or connected with such transactions or any related dispute.

10. Privacy

Your personal information is handled in accordance with our Privacy Policy, and may also be subject to Shopify's Privacy Policy (https://www.shopify.com/legal/privacy/app-users). Shopify collects and processes personal information to provide and improve the Services, and data may be transferred or shared internationally.

11. Feedback

If you send us ideas, suggestions, feedback or reviews, you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display them for any purpose, including commercial purposes. You confirm that you own or have the rights to your feedback, and you must disclose any incentive you received. We have no obligation of confidentiality, payment or response. We may monitor, edit or remove feedback. Feedback must not infringe third-party rights or contain unlawful, abusive, obscene or malicious content, and you must not impersonate anyone. You are responsible for your feedback.

12. Errors, inaccuracies and omissions

The Services may contain errors in descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct any error and change or update information, or cancel an order, without prior notice, including after you have submitted it. Where an order is cancelled after payment, we refund you.

13. Prohibited uses

You may use the Services for lawful purposes only. You must not, for example, use robots, scrapers, AI tools (including agentic AI) or other automated means to access the Services, circumvent security, or otherwise misuse the Services. We may suspend, disable or terminate accounts that breach this section.

14. Agents ("Agent Terms")

This section applies to any software or service that takes autonomous or semi-autonomous action ("Agent"). Agents must identify themselves in their HTTP(S) requests using a user-agent string in the form "Agent/[agent name]". Agents must not conceal their automated nature, mimic a human, or bypass CAPTCHAs or other controls. If asked whether they are human or computer, Agents must answer truthfully. Agents must not circumvent technical controls, and we may technically limit Agents.

15. Termination

We may terminate access to the Services at any time without notice. Sections that by their nature should survive termination remain in force, including: Intellectual Property; Feedback; Termination; Disclaimer of Warranties; Limitation of Liability; Indemnification; Severability; Waiver and Entire Agreement; Assignment; Governing Law; and Privacy.

16. Disclaimer of warranties

Information on the Services is provided for general information only, with no warranty of accuracy, completeness or usefulness. The Services and products are provided "as is" and "as available" without warranties, including merchantability, fitness for a particular purpose, durability, title and non-infringement, except as required by mandatory law. We do not guarantee uninterrupted, timely, secure or error-free operation. Some jurisdictions limit these disclaimers, and your statutory consumer rights are not affected.

17. Limitation of liability

To the fullest extent permitted by law, neither Dory nor Shopify, nor their affiliates, are liable for any injury, loss or claim, or for any indirect, incidental, punitive, special or consequential damages, including lost profits, revenue, savings or data, or replacement costs, arising from your use of the Services or products. Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law. If you are a consumer, your mandatory statutory rights are not affected.

18. Indemnification

You agree to indemnify and hold harmless Dory, Shopify and their affiliates from claims arising from your breach of these Terms, your violation of law or third-party rights, or your use of the Services. We will notify you of any such claim and may control its defence.

19. Severability

If any provision of these Terms is found unenforceable, it is severed and the remaining provisions stay valid.

20. Waiver and entire agreement

Our failure to enforce any provision is not a waiver. These Terms, together with the policies posted on the Services, are the entire agreement between you and us. Any ambiguity will not be construed against the drafter.

21. Assignment

You may not assign these Terms without our consent. We may assign them freely.

22. Governing law and jurisdiction

These Terms are governed by Italian law. The competent courts are the Italian courts of the place of establishment of the seller, that is the courts of the province of Rieti (Tribunale di Rieti), which covers Montopoli di Sabina.

If you are a consumer resident in the European Union, this choice does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence, and you may also bring proceedings in the courts of your place of residence. EU distance-selling rights under Directive 2011/83/EU, as implemented in Italy by Legislative Decree 206/2005 (the "Consumer Code"), are preserved. Where physical products are placed on the EU market, we will comply with applicable product-safety rules, including the General Product Safety Regulation (Regulation (EU) 2023/988).

Consumers may use the alternative dispute resolution (ADR) bodies available in their country. Note: the European Commission's Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 (Regulation (EU) 2024/3228 repealing Regulation (EU) 524/2013), so no ODR link is provided.

23. Headings

Headings are for convenience only and do not affect interpretation.

24. Changes to these Terms of Service

The current version is always on this page. We may update these Terms by posting a revised version. It is your responsibility to check for changes. Material changes will be notified as required by law. Continued use of the Services after an update means you accept the revised Terms.
